The entire 277 pages of the opinion are worth reading for the complex interplay of politics, of the legal structures within which governance through data harvesting (strategically conceived), and of the role of the courts in mediating issues of data, data analytics and governance through mechanisms of more intensive structures for caging the exercise of administrative discretion, suggest the emerging American approaches to the construction of data driven governance.
